These Terms of Service ("Terms") govern your access to and use of Kindslot on kindslot.com (the "Service"), operated by MB DIGITAL PARTNERS LTD ("Kindslot", "we", "our", or "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Kindslot is a free-to-play rewards platform. Kindslot does not offer gambling, deposits, cash-out, or real-money wagering.

1. Eligibility and account registration

If we discover or reasonably believe that a user does not meet these eligibility requirements, we may suspend or terminate the account, remove Points, and deny or cancel any Reward redemption.

You agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Description of the Service

Service Nature: Free-to-play entertainment, no gambling, point mechanics, and policy incorporation.

Kindslot is an entertainment platform offering free-to-play games and related features. No real-money wagering is offered. No purchase is necessary to use the Service. You may earn points through gameplay, challenges, and participating in eligible promotional offers ("Points"). Points may be redeemable for certain digital coupons or gift cards ("Rewards"), subject to availability and verification. Points are not money, have no cash value, are not property, and are not transferable. Kindslot does not operate sweepstakes, contests, raffles, or lotteries unless we explicitly publish separate official rules for a specific promotion. Your use of the Service is also subject to our Privacy Policy, Cookie Policy, and Rewards and Redemption Policy, which are incorporated into these Terms by reference.

3. Rewards, redemptions, and verification

Digital gift cards and other rewards may only be redeemed by users who are at least 18 years old, or the age of majority in their jurisdiction, whichever is higher. Kindslot reserves the right to deny, suspend, or cancel any redemption request if it reasonably believes that a user does not meet the applicable eligibility requirements or has provided inaccurate information. Rewards are promotional and provided on an "as available" basis. We may, at any time and in our discretion: change Points earning rates, redemption thresholds, or reward catalogs; limit redemptions, impose cooldowns, or require additional eligibility checks; delay or deny redemptions where we reasonably suspect fraud, abuse, or technical error. To protect the Service and our partners, we may require verification for certain activities or redemptions. Verification may include confirming account ownership, device or activity checks, and in some cases identity verification. If you do not complete verification when required, you may be unable to redeem Rewards. You are responsible for any taxes or reporting obligations related to Rewards, if any.

4. Third-party content, ads, and offers

The Service may include third-party advertisements and offers (including offerwalls). Third parties may operate their own sites or apps and may collect information under their own terms and privacy policies. Your interactions with third-party offers are between you and the third party. We do not control and are not responsible for third-party products, services, or content. We may receive attribution and completion information from offer partners to credit Points and prevent fraud. If a third-party offer is reversed, rejected, or charged back by the partner, we may remove the related Points or Rewards from your account.

5. Acceptable use and fair play

User Conduct: Prohibited actions including bots, multiple accounts, and system interference.

You agree not to: create multiple accounts, fake accounts, or use someone else's account; use bots, scripts, automation, emulators, exploits, or other methods to manipulate gameplay, ads, offers, Points, or Rewards; attempt to bypass rate limits, access restrictions, or security measures; interfere with the Service, including by introducing malware or performing denial-of-service attacks; use the Service for unlawful, harmful, or abusive purposes.

6. Suspension and termination

Account Closure: Conditions under which access may be revoked and loss of accumulated points.

We may suspend or terminate your access to the Service at any time if we believe you violated these Terms, engaged in fraud or abuse, or used the Service in a way that creates risk for us or others. If your account is suspended or terminated, you may lose access to Points and Rewards, to the fullest extent permitted by law.

7. Intellectual property

Ownership: Proprietary rights of Kindslot and the limited license granted to users.

The Service, including its software, games, design, and content, is owned by MB DIGITAL PARTNERS LTD or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

8. DMCA and copyright complaints

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT REWARDS WILL ALWAYS BE AVAILABLE. WE ARE NOT RESPONSIBLE FOR THIRD-PARTY OFFERS, ADS, OR CONTENT, OR FOR ISSUES CAUSED BY THIRD-PARTY SERVICES. WE ARE NOT RESPONSIBLE FOR LOSSES CAUSED BY HACKING, MALWARE, PHISHING, ACCOUNT TAKEOVERS, OR EVENTS OUTSIDE OUR REASONABLE CONTROL. YOU ARE RESPONSIBLE FOR KEEPING YOUR ACCOUNT CREDENTIALS SECURE.

10. Limitation of liability

Liability Caps: Financial limits on claims and exclusion of specific types of damages.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL KINDSLOT OR ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED GBP 100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER. BECAUSE THE SERVICE IS FREE-TO-USE, IN MANY CASES THIS AMOUNT WILL BE GBP 100.

11. Indemnification

User Liability: Your agreement to protect Kindslot from legal costs arising from your actions.

You agree to indemnify and hold harmless Kindslot and its affiliates, directors, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Dispute resolution and arbitration (U.S. users)

US Legal: Mandatory arbitration, class action waiver, and opt-out procedures for US residents.

This section applies only if you reside in the United States, to the extent permitted by law. Informal resolution: Before starting arbitration, you agree to contact us at legal@kindslot.com and provide a brief description of the dispute and the relief sought. We will try to resolve the dispute informally. Binding arbitration: If we cannot resolve the dispute informally, you and Kindslot agree to resolve any dispute arising out of or relating to these Terms or the Service through binding, individual arbitration, and not in court. No class actions: You and Kindslot agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Small claims: Either party may bring an individual claim in small claims court if it qualifies and remains in small claims court. Procedure: Unless otherwise required by law, arbitration may be conducted by videoconference or written submissions. The arbitrator may award the same remedies available in court. Opt-out: You may opt out of this arbitration agreement by emailing legal@kindslot.com within 30 days of first accepting these Terms, stating you want to opt out of arbitration.

13. Dispute resolution (non-U.S. users)

International Legal: Jurisdiction for non-US users, focusing on English and Welsh courts.

If you do not reside in the United States, or if arbitration is not permitted, disputes will be brought in the courts of England and Wales, except where mandatory consumer laws provide otherwise.

14. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict of laws principles.

15. Changes to the Service and Terms

Updates: Our right to modify the service or terms and user acceptance by continued use.

We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time by posting the updated Terms on the Service and updating the effective date above. Your continued use of the Service after changes become effective means you accept the updated Terms.
